These Terms & Conditions explain the terms on which we sell our products through our website. Please read them carefully before placing an order.
Nothing in these Terms & Conditions affects your statutory consumer rights.

Marianne's is an independent UK business specialising in handmade knitwear, carefully selected boutique clothing, gifts and accessories.
Marianne's is the trading name of Marianne Duffield, operating as a sole trader in the United Kingdom.

2. Acceptance of These Terms
These Terms & Conditions apply to purchases made through the Marianne's website.
Please read these Terms & Conditions, together with our Privacy Policy, Returns & Refunds Policy and Shipping & Delivery Policy, before placing an order.
By placing an order, you agree to the terms applicable to your purchase, subject to your statutory consumer rights.
3. Products
We make every effort to describe our products accurately and display colours and photographs as faithfully as possible.
As many of our garments are individually handmade, small natural variations in stitch definition, texture, measurements and finish may occur.
Measurements shown are approximate unless otherwise stated.
These variations do not affect your statutory rights. All products must be of satisfactory quality, fit for purpose and as described.
4. Made-to-Order and Bespoke Garments
Some Marianne's garments are available on a made-to-order or bespoke basis.
As our knitwear is individually handcrafted, production times vary according to the complexity of the design, availability of materials and the knitter's workload.
Production normally takes approximately 2–8 weeks, although particularly intricate garments may require longer.
An estimated completion time will be agreed before an order is confirmed. Production time is separate from delivery time.
Deposits and Payment
A deposit of 25% of the agreed purchase price is normally required for made-to-order garments.
For particularly intricate, expensive or bespoke commissions, a deposit of up to 50% may be required.
The applicable deposit amount will be confirmed before the order is placed.
The remaining balance becomes payable when the garment is completed and before dispatch.
Customer Specifications
Where a garment is produced to a customer's individual specifications, including specially agreed measurements, colours, designs or personalisation, these details will be confirmed before production begins.
Customers are asked to check their agreed specifications carefully and notify us promptly of any errors.
Cancellations and Returns
Standard made-to-order garments that are not produced to individual customer specifications generally remain subject to the statutory cancellation rights applicable to online purchases.
Garments made to a customer's individual specifications or clearly personalised may be exempt from the statutory 14-day cancellation right.
Any applicable cancellation restrictions will be explained before the order is confirmed.
Where a customer has a statutory right to cancel, deposits will be refunded in accordance with that right.
For genuinely bespoke or personalised commissions exempt from the statutory cancellation right, any cancellation arrangements and amounts retained must be fair, reasonable and lawful.
Deposits are not automatically non-refundable.
Nothing in these terms affects a customer's statutory rights where goods are faulty, not as described or otherwise fail to meet applicable legal requirements.

5. Marianne's Misfits
Marianne's Misfits is our collection of individually handcrafted garments offered at reduced prices because of minor cosmetic imperfections.
These may include women's knitwear, men's knitwear, babywear, children's garments and accessories.
Every known imperfection will be clearly described in the product listing before purchase.
By purchasing a Marianne's Misfits item, customers acknowledge the imperfections disclosed in the product description and photographs.
These disclosed imperfections are reflected in the reduced selling price and do not, by themselves, constitute faults for which a remedy may be claimed on the basis of those imperfections.
Marianne's Misfits purchased online remain subject to applicable statutory cancellation rights.
Customers retain their statutory rights where an item has an undisclosed fault, is not as described or otherwise fails to meet applicable legal requirements.

6. Pricing
All prices are displayed in the currency shown on our website.
The total price, including applicable delivery charges and any taxes collected by Marianne's, will be shown before the customer confirms an order.
Prices may be changed at any time without notice. However, price changes will not affect orders that have already been accepted.
Customers ordering from outside the United Kingdom may be responsible for customs duties, import taxes or other charges imposed by their destination country, unless otherwise stated at checkout.
Any additional charges payable to customs authorities or delivery providers are outside Marianne's control.
7. Orders
All orders are subject to acceptance and product availability.
After placing an order, customers will receive an acknowledgement using the contact details provided.
An order acknowledgement does not necessarily mean that the order has been accepted. The contract is formed when Marianne's confirms acceptance of the order.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
If payment has already been taken for an order that Marianne's declines or cancels, the amount paid will be refunded.
Nothing in this section affects the customer's statutory rights.
8. Payment
Payments are processed securely through authorised payment providers.
Marianne's does not store or have access to customers' full payment card details.
For standard online purchases, payment is normally required when the order is placed.
For made-to-order and bespoke commissions, the deposit and balance arrangements described in Section 4 apply.
Orders will not normally be dispatched until the agreed payment has been received in full.
9. Delivery
Marianne's delivers throughout the United Kingdom and to selected international destinations.
Estimated production and delivery times are provided as guidance and may vary depending on the product, destination and delivery service.
Marianne's will make reasonable efforts to dispatch and deliver orders within the agreed timescales and will comply with applicable statutory delivery obligations.
If a delay occurs, customers will be informed where reasonably possible.
Customers retain their statutory rights concerning delayed, missing or undelivered goods.
Risk in the goods normally passes to the customer when the goods come into their physical possession, or that of a person identified by them to receive delivery, subject to applicable law.

10. Returns & Refunds
Returns, cancellations and refunds are governed by our Returns & Refunds Policy, together with any applicable statutory consumer rights.

11. Intellectual Property
All original content on this website, including photographs, product descriptions, logos, branding, graphics, artwork and designs, is owned by or licensed to Marianne's and may be protected by applicable intellectual property laws.
No such content may be copied, reproduced, distributed or used commercially without the relevant rights holder's permission, except where permitted by law.
12. Handmade Designs
Unless otherwise stated, Marianne's original designs, product photography and branding remain the intellectual property of Marianne's or their respective rights holders.
Purchasing a garment does not transfer ownership of any intellectual property rights in its original design, branding or associated creative materials.

14. Limitation of Liability
Nothing in these Terms & Conditions excludes or restricts liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded or restricted.

Marianne's is not responsible for losses that were not reasonably foreseeable when the contract was made, except where liability cannot lawfully be excluded.

Personal information collected through our website will be handled in accordance with our Privacy Policy and applicable data protection legislation.

These Terms & Conditions are governed by the laws of England and Wales.
Nothing in these Terms & Conditions removes or restricts any mandatory consumer protections or rights concerning where legal proceedings may be brought under applicable law.
